Terms of Service

These Terms govern how shoppers, sellers, couriers, and visitors use Tillr. They are written for a local marketplace where neighborhood food, farm goods, cottage food products, and shop items can be ordered for delivery or pickup.

Agreement to these Terms

These Terms of Service ("Terms") are a legal agreement between you and Tillr Holdings, LLC ("Tillr," "we," "us," or "our"). They govern your access to and use of Tillr websites, mobile applications, marketplace, delivery, pickup, seller, support, and related services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Our marketplace and payment role

Tillr provides a local marketplace that helps shoppers discover and order goods from independent farmers market vendors, cottage food sellers, home-based food producers, local shops, and other sellers. Sellers are independent businesses and are not employees, agents, partners, or representatives of Tillr.

For customer-facing payments, receipts, refunds, credits, and order support, Tillr may act as the merchant of record or payment collection platform. Payment processors such as Stripe provide payment processing services and do not assume responsibility to customers for seller products, delivery, refunds, credits, replacements, or support.

Unless Tillr expressly states otherwise, Tillr does not manufacture, grow, cook, package, label, store, inspect, or control seller products. Sellers are responsible for their products, listings, prices, availability, ingredients, labels, claims, packaging, safety, compliance, taxes, permits, insurance, and fulfillment obligations.

Eligibility and accounts

You must be at least 18 years old to create an account, place orders, sell, deliver, or otherwise use the Services. You are responsible for providing accurate information, keeping your account credentials secure, and all activity under your account.

We may refuse, suspend, or terminate access to the Services if we believe account information is inaccurate, activity is unsafe or fraudulent, or use of the Services violates these Terms or applicable law.

Orders, pricing, and payment

Prices, availability, fees, taxes, tips, delivery options, pickup windows, and promotions may change. When you place an order, you authorize Tillr and our payment processors to charge the payment method you provide for the order total and any permitted adjustments, including substitutions, added items, refunds, tips, credits, or fees.

Sellers may accept, reject, cancel, or modify orders when items are unavailable, when an order cannot be fulfilled safely or lawfully, or as otherwise allowed by Tillr policies. We may correct pricing, availability, or listing errors.

Delivery and pickup

Delivery is offered by vendor choice. Vendors may fulfill delivery using their own delivery drivers or, when available, choose Tillr drivers. Seller-provided drivers are the seller's responsibility. Tillr drivers are subject to Tillr courier requirements.

Delivery and pickup times are estimates and are not guaranteed. Weather, traffic, seller preparation, product availability, address issues, courier availability, or other circumstances may cause delays or cancellations.

Perishable or temperature-sensitive goods must be packaged, staged, handed off, delivered, and received in a manner consistent with applicable safety requirements and seller handling instructions. You are responsible for accurate delivery and pickup information, being available to receive perishable goods, and promptly retrieving orders made available for pickup. Risk of loss may pass to you when an order is delivered, picked up, or made available for pickup.

Food safety, allergens, and cottage food

Tillr includes sellers who may operate under local farmers market, cottage food, home kitchen, retail food, or similar laws. Some cottage food products may be prepared in home kitchens and may not be inspected in the same manner as restaurants or commercial food facilities.

Sellers are responsible for all food safety, labeling, ingredient, allergen, storage, temperature control, transport, recall, licensing, registration, certification, insurance, and cottage food requirements that apply to their products and chosen delivery method.

Sellers must not list, sell, ship, deliver, or arrange delivery of any cottage food or regulated item through Tillr unless platform sales, pickup, and the selected delivery method are lawful for that product. Sellers must provide item-level ingredients, allergen disclosures, labels, warnings, safe handling instructions, and required legal notices where applicable. Shoppers are responsible for reviewing product information and contacting sellers or Tillr with questions before ordering. Tillr does not guarantee that products are free from allergens, cross-contact, contamination, mislabeling, spoilage, or other food safety risks.

Seller obligations

Every seller, including cottage food sellers, home-based sellers, farmers market vendors, local shops, and other vendors, must maintain an active business license and every state, local, and category-specific license, permit, registration, certification, approval, or insurance required to sell through Tillr.

Sellers must provide accurate product descriptions, photos, prices, ingredients, allergen disclosures, labels, warnings, safe handling instructions, legal notices, availability, and fulfillment information. Sellers are responsible for recalls, regulatory inquiries, customer complaints, taxes, seller-caused refunds, chargebacks, and any claim arising from their products, listings, operations, or delivery choices.

Tillr may request documentation, perform verification checks, restrict listings, withhold payouts, suspend sellers, or remove products. Any review or verification by Tillr does not guarantee that a seller, product, license, label, or delivery method complies with law.

Seller, courier, and delivery terms

Selling, delivering, or performing courier services through Tillr may require separate seller, courier, delivery, payout, onboarding, verification, insurance, or operating terms. Those terms supplement these Terms and control for the specific seller, courier, or delivery activity if there is a conflict.

Couriers and seller-provided drivers must comply with applicable law, driving, insurance, safety, identity, age, restricted-item, and handling requirements. They must follow seller handling instructions, protect perishable goods during handoff and transport, and report delivery issues promptly.

Cancellations, refunds, and credits

Refunds, credits, replacements, and cancellations may be provided at Tillr's discretion, under seller policies, under Tillr policies, or where required by law. Perishable, prepared, custom, limited-quantity, or time-sensitive goods may not be eligible for cancellation or refund once preparation, delivery, or pickup has started.

Tillr assumes customer-facing responsibility for issuing refunds or credits when a vendor cannot provide a required customer remedy. Tillr may recover those amounts from the responsible seller. Stripe and other payment processors do not assume that customer refund or credit responsibility.

If you dispute a charge, request a chargeback, or receive a refund, credit, replacement, Tillr+ reward, Till, promotion, or other benefit, you may not obtain duplicate recovery for the same issue. Tillr may reverse or adjust credits, promotions, Tills, Tillr+ rewards, or account benefits after refunds, cancellations, fraud, abuse, error, or violation of these Terms. Credits, Tills, and Tillr+ rewards have no cash value unless Tillr expressly states otherwise.

If there is a problem with an order, contact us promptly at contact@gettillr.app and include the order details and a description of the issue.

Restricted items and conduct

You may not use the Services to buy, sell, deliver, request, or promote goods that are illegal, unsafe, counterfeit, stolen, recalled, adulterated, misbranded, mislabeled, infringing, or otherwise prohibited by Tillr or applicable law.

Some categories are regulated, age-restricted, fulfillment-restricted, or subject to additional approval rather than automatically prohibited. These may include alcohol, tobacco, nicotine, cannabis, hemp or CBD products, controlled substances or prescription products where lawful, over-the-counter medical products, pharmacy goods, weapons, live animals, hazardous or household chemical products, and regulated food products. These items may be listed, sold, picked up, or delivered only if Tillr enables the category and all licensing, age or identity verification, labeling, storage, handling, pickup, delivery, and other legal requirements are met.

You may not misuse the Services, interfere with operations, scrape or copy content without permission, attempt unauthorized access, harass other users, submit false information, manipulate reviews, evade fees, or use the Services for fraudulent, harmful, or unlawful activity.

Content and feedback

You may submit listings, photos, reviews, messages, feedback, and other content. You retain ownership of your content, but you grant Tillr a worldwide, non-exclusive, royalty-free license to host, use, reproduce, display, distribute, modify, and create derivative works from that content to operate, promote, improve, and protect the Services.

Reviews must be honest, based on genuine experience, and not fraudulent, paid, coerced, misleading, defamatory, harassing, or manipulated. You are responsible for your content and must have all rights needed to submit it. We may remove or restrict content that violates these Terms, Tillr policies, or applicable law.

Copyright or DMCA notices may be sent to contact@gettillr.app and should include the required copyright owner information, the work claimed to be infringed, the material location, contact information, a good-faith statement, an accuracy statement, and a physical or electronic signature. We may remove content and terminate repeat infringers where appropriate.

Third-party services

The Services may integrate with third-party services, including payment processors, identity verification providers, maps, messaging tools, analytics providers, app stores, and seller or delivery tools. Their terms and privacy policies may apply to your use of those services.

Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." Tillr disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Tillr does not warrant that the Services will be uninterrupted, error-free, secure, accurate, or available at any particular time or place, or that seller products will meet your expectations.

Limitation of liability

To the fullest extent permitted by law, Tillr and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from or related to the Services.

Except for Tillr's customer-facing refund or credit obligations expressly described in these Terms, and except for liability that cannot legally be limited, Tillr's total liability for any claim arising from or related to the Services will not exceed the greater of the amount you paid to Tillr for the order or service giving rise to the claim or $100.

Indemnification

You agree to defend, indemnify, and hold harmless Tillr and its owners, officers, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Services, your content, your products or listings, your delivery or courier activity, your seller-provided drivers, your violation of these Terms, your violation of law, or your infringement of another person's rights.

If you are a seller or courier, this includes claims related to licenses, permits, registrations, certifications, approvals, insurance, labels, allergens, food safety, restricted goods, recalls, taxes, cold-chain handling, employment or contractor status, seller-caused refunds, and chargebacks. This indemnity does not require you to indemnify Tillr for claims caused solely by Tillr's gross negligence, willful misconduct, or non-waivable legal obligations.

Suspension and termination

We may suspend, restrict, or terminate access to the Services at any time if we believe doing so is necessary to protect users, sellers, couriers, Tillr, or the public, or if you violate these Terms, applicable law, or Tillr policies.

Order issues and disputes

For order problems, contact Tillr promptly at contact@gettillr.app with the order details, issue description, and available photos or documentation. For perishable, temperature, missing, damaged, or safety concerns, report the issue as soon as reasonably possible.

Before filing a legal claim, you and Tillr agree to try to resolve the dispute informally for 30 days after written notice describing the dispute and requested resolution. Either party may still seek urgent injunctive relief, respond to chargebacks, protect account security, or take action required by law.

Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of laws rules, except where applicable law requires otherwise. Any dispute that is not resolved informally will be brought in the state or federal courts located in Kentucky, unless applicable law requires another forum.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and provide additional notice where required. Your continued use of the Services after changes take effect means you accept the updated Terms.
